Preamble
We, the Karnalian people,
Whereas we are mindful of our responsibility towards creation;
Resolving to renew our alliance to strengthen liberty and democracy, independence and peace in solidarity and openness towards the world;
Determined to live our diversity in unity respecting one another;
Conscious of our common achievements and our responsibility towards furure generations; and
Knowing that only those remain free who use their freedom, and that the strength of a people is measured by the welfare of the weakest of its members;
Therefore we adopt the following Constitution:
The Bill of Rights
Article I - Free Speech and Privacy
The government shall make no law abridging the freedom of speech, of the press, or of any other type of communication; or restricting the right of an individual to petition the government for a redress of grievances; or respecting an establishment of religion or prohibiting the free or non-exercise thereof; or requiring an individual to give out personal details.
Article II - Right to Self-Defence Against the Initiation of Force or Fraud
The right of an individual to preserve, protect and defend his life, liberty and property, or that of any other party subject to the initiation of public or private force or fraud shall not be infringed.
Article III - Right to Repudiate a Government in Rebellion
The right of an individual to organise the overthrow of a government initiating force against its citizens shall not be infringed; and any individual may disobey any order which conflicts with the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process.
Article IV - Property Rights
The right of an individual to be secure in his person, effects, reputation, intellectual property and other properties, against unreasonable searches and seizures, shall not be infringed, and no warrants shall issue but upon probable cause, and particularly describing the individual to be searched, and the person or things to be seized; and no individual shall be deprived of rights, liberties or properties without due process of law; nor shall private property ever be taken compulsorily for public use.
Article V- Right of Self-Ownership
The government shall make no law restricting the right of an individual to do anything with his life unless the individual presents an objective threat to the rights and liberties of other individuals.
Article VI - Free Association
All interaction between individuals shall be voluntary and any voluntary association of individuals shall be deemed to have the rights of the individuals comprising it.
Therefore the government shall make no law restricting the right of an individual peaceably to assemble or to join together; or requiring an individual to join, contribute to, be registered or be enrolled with any association; or establishing a monopoly and otherwise restricting the number or nature of businesses; or requiring an individual to join any branch of the government.
Article VII - No Compulsory Taxation
The government shall extract no compulsory tax or involuntary contribution of any kind from any citizen for any purpose whatsoever.
Article VIII - Free Trade, Investment and Migration
The government shall make no law regulating commerce, investment or migration; but the government may regulate the immigration of any individual who has aided or given comfort to the enemy in any war or revolution respecting the establishment of the Constitution.
The Bill of Due Process
Article A - Treason
Treason against the citizens of the Republic shall consist only in levying war against them, or in giving aid and comfort to an enemy which shall pose an objective threat.
Article B - Charge and Depositions
Any individual who is charged with an offence shall enjoy and shall be informed of the right to know in detail the nature and cause of the charge without delay; to consult and instruct a legal advisor; to have the assistance of counsel and interpreters for his defence; to have sufficient time and facilities to prepare a defence; and to be brought before a court without delay.
And no individual shall be held to answer for punishable offence unless the Republican Judge decides there is a case to answer.
Article C - Criminal and Civil Procedure
In all criminal prosecutions and civil suits, the accused or defendant shall enjoy the right to be presumed innocent until proven guilty or found against; to a fair, speedy and public trial or case, at his election, excepting a trial of impeachment, before the Republican Judge; to be informed in detail of the nature and cause of the allegation; to be presented with the evidence against him; to have the assistance of advisors for his defence; to have sufficient time and facilities to prepare and present a defence; and to be present at his own trial or case.
Article D - General Procedure
No individual shall twice face a civil suit or criminal prosecution for the same breach, liability or offence; nor shall face a hearing, inquiry, civil suit or criminal prosecution for a breach, liability or offence which at the time of its alleged commission was not a breach, liability or offence; nor shall be compelled in any hearing, inquiry, suit or trial to be a witness.
Article E - Private Prosecutions and Civil Suits Involving Government
All civil suits involving the government shall be heard in the same manner as civil suits between individuals, and all criminal prosecutions brought by an individual, including a prosecution against the government, shall be heard in the same manner as criminal prosecutions brought by the government; and the right of an individual to bring or defend these proceedings shall not be infringed.
Article F - No Excessive Bail, Excessive Fines or Cruel and Unusual Punishments
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Article G - Asset Forfeiture and Victim Restitution
Private and public property shall not be deemed the proceeds of crime unless the criminal burden of proof is met, nor shall be deemed the award of costs or damages unless the civil burden of proof is met; and the proceeds of crime shall be returned to the victims from whence they came or alternative but equivalent restitution enforced.
Article H - Finding of Fact and Mistake
The Republican Judge may repair to the traditional precedents of common law, equity and admiralty law where appropriate and create new precedents, provided all these precedents shall be consistent and shall not conflict with the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process; and no fact tried by the judge shall be otherwise re-examined in the Republican Court according to these rules.
Government
Section 1 - Composition of Legislature
1) All legislative powers granted shall be vested in the Republican Parliament.
2) The Republican Parliament shall be composed of all citizens of the Republic.
Section 2 - Composition of Executive
1) To prevent the establishment of a privileged executive presidency, accumulating and monopolising power and ruling by decree and executive orders, all executive powers granted shall be vested in the Republican Triumvirate, which shall consist of three tribunes, who shall each be a Protector of the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process.
2) The Tribunes shall be directly chosen by the citizens:
a) every six months, unless the Republican Parliament agrees to a mid-term election which will be held after three months
b) who are registered voters
3) In case of the removal of a Tribune from office, there will be elections to elect a Tribune to replace the removed one.
4) Any citizen may stand for election as a Tribune; but no individual may stand for election as Tribune if he has been thrice elected. If a Tribune's status is confirmed in the mid term election, it is still considered the same term.
5) Each Tribune shall nominate all members of the Cabinet of the Triumvirate, and the Republican Judge, and all other officers of the Republic whose appointments are not herein otherwise provided for and which shall be established by law; but the Republican Parliament shall only consent to one of the three nominees being appointed for a particular appointment, or shall reject all nominees in which case each Tribune shall nominate a new individual to be nominee.
6) The Cabinet portfolios to be appointed shall comprise a Minister of Economics and Foreign Affairs; and two directors of the KIA. A single individual may take up to two of these posts as long as the individual is not a Tribune.
7) Responsibility for internal intelligence and the protection shall lie solely with the Civil Defence Directorate of the KIA; responsibility for external intelligence and defence from military threats shall lie solely with the Military Defence Directorate of the KIA.
8) A Tribune may, by and with the consent of the Republican Parliament, remove public ministers of the Cabinet of the Triumvirate, and other officers of the Republic whose appointments are not herein otherwise provided for and which shall be established by law, excepting the Republican Judge.
9) Any individual in the universe, may be nominated a public minister, or other officer of the Republic. Any individual may be nominated Republican Judge except a Tribune.
Section 3 - Composition of Judiciary
1) All judicial powers granted shall be vested in the Republican Court.
2) The Republican Court shall be headed by the Republican Judge who is nominated by the Tribunes and appointed by the Republican Parliament.
3) The Republican Judge must be present at all hearings. In the event of a temporary vacancy in his position, the vacancy shall be filled according to the aforementioned process for nominating and appointing the judge.
Section 4 - Powers of Legislature
1) Any Tribune, Judge, or other senior officer of the Republic who acts or fails to act in such a manner as to jeopardise the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process shall be liable to a charge of impeachment.
2) Any individual shall have the power of impeachment.
3) The Republican Parliament shall have the sole power to try all impeachments. When a Tribune of the Triumvirate of the Republic is tried, the Republican Court shall preside: and no individual shall be convicted without the concurrence of three-quarters of the Members.
4) The Republican Parliament shall, consistent with the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process, be the judge of the elections, returns, qualifications of its own Members, and a majority shall constitute a quorum to do business.
5) The Republican Parliament may determine the rules of their proceedings, and punish their Members for disorderly behaviour.
6) All statutes and amendments shall originate in the Republican Parliament and shall be introduced in that place only by a majority of present voters.
7) The Republican Parliament shall have the sole power:
a) to collect and administer voluntary contributions; ;
b) to establish a uniform rule of naturalisation;
c) to make or declare war
d) to provide and maintain the KIA;
e) to make rules for the government and regulation of the KIA;
f) to provide for calling forth individuals, to voluntarily assist the KIA; and to make all laws which shall be necessary and proper for carrying into execution the foregoing powers.
8) No money shall be drawn from the Treasury, but in consequence of appropriations made by law.
Section 5 - Tribunician Power of Executive and Overriding Power of Legislature
1) Upon presentment of a statute or amendment, any Tribune can exercise his Tribunician power to veto.
2) If after such action, and if only one Tribune has exercised his Tribunician power, three-fifths of the Republican Parliament will have to agree to pass the statute or amendment in order for it to be law.
If after such action, and if one Tribune has exercised his or her Tribunician power, two-thirds of the Republican Parliament will have to agree to pass the statute or amendment in order for it to be law.
If after such action, and if two Tribunes have exercised their Tribunician power, three-fifths of the Republican Parliament will have to agree to pass the statute or amendment in order for it to be law.
If after such action, and if three Tribunes have exercised their Tribunician power, three-foruths of the Republican Parliament will have agreed to pass the statute or amendment in order for it to be law.
A tribune may not exercise his right to veto and vote on the same statute or amendment. A tribune may annul the veto exercised by another Tribune by exercising his right to a counter-veto; but the Tribune may not vote on a statute or amendment if he has exercised his counter-veto right on it.
3) The Tribune will exercise his right to veto within the standard voting session.
4) Every order, resolution, or vote to which the concurrence of the Republican Parliament may be necessary, except on:
a) a question of adjournment;
b) choosing any officers of the Republican Parliament;
c) declaration of an officer to act as Tribune;
d) appointment and, excepting judges, removal of public ministers of the Cabinet of the Triumvirate, judges, and other officers of the Republic whose appointments are not herein otherwise provided for and which shall be established by law;
e) trial of impeachment;
f) determination of rules for the proceedings and punishment of the Members of the Republican Parliament;
g) appointment of War Tribune;
h) making and declaration of war; or
i) rejecting, nulling and voiding a Tribunician Order
Section 6 - Powers of Executive
1) The Republican Parliament shall appoint a War Tribune who shall be the Commander-in-Chief of the KIA.
2) Any Tribune may require the opinion, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices, and he shall have the power to grant reprieves.
3) A Tribune shall have power, by and with the advice and consent of the Republican Parliament, to make treaties which shall have the effect of law, provided two-thirds of the members of the Republican Parliament concur; but any individual may appeal this effect directly to the Republican Court.
4) The Triumvirate shall from time to time give to the Republican Parliament information of the state of the Republic, and recommend to their consideration such measures as it shall judge necessary and expedient.
5) The Triumvirate shall take care that the laws passed by the Republican Parliament be faithfully executed, shall commission all the officers of the Republic, and shall issue any requisite Tribunician Order thereupon arising. In any conflict between Tribunes, the decision of the relevant Minister shall have precedence (but a Tribune may request that the Republican Parliament appoint him War Tribune or consent to the removal of the Minister).
6) Any Tribunician Order that infringes upon the rights and l-berties eternally enshrined in the Bill of Rights and Bill of Due Process or infringes upon the powers and duties of the Republican Parliament or requires the use of public funds not specifically appropriated for the purpose of the aforementioned Tribunician Order shall be advisory only and shall have no legal effect; and the Republican Parliament shall within three days reject, null and void such Tribunician Order.
7) The Minister of the relevant department, and head of the relevant department shall certify that any regulation emanating pursuant to any bill or amendment, or any regulation or guideline emanating from a government department and affecting a private individual, does comply with the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process.
8) The Tribunes, and all civil officers of the Republic, shall be removed from office on impeachment for, and conviction of, any imprisonable offence.
Section 7 - Powers of Judiciary
1) The judicial power shall extend: a) to all cases, including cases in what may be referred to as common law, equity and admiralty law, arising under this Constitution, the laws of the Republic, and treaties made, or which shall be made, under her authority; b) to controversies to which the Republic shall be a party; and c) between the and foreign states, citizens or subjects.
2) The Republican Judge shall be removed from office on impeachment for, and conviction of, any imprisonable offence.
Section 8 - Local Government
1) There shall be no local government.
Section 9 - Amendments to the Constitution
1) The Republican Parliament, whenever three-quarters of Members who vote shall deem it necessary, shall propose Amendments to the constitution, which shall be valid to all intents and purposes, as part of this Constitution.

6) Any Tribunician Order that infringes upon the rights and l-berties eternally enshrined in the Bill of Rights and Bill of Due Process or infringes upon the powers and duties of the Republican Parliament or requires the use of public funds not specifically appropriated for the purpose of the aforementioned Tribunician Order shall be advisory only and shall have no legal effect; and the Republican Parliament shall within three days reject, null and void such Tribunician Order.
7) The Minister of the relevant department, and head of the relevant department shall certify that any regulation emanating pursuant to any bill or amendment, or any regulation or guideline emanating from a government department and affecting a private individual, does comply with the rights and liberties eternally enshrined in the Bill of Rights and Bill of Due Process.
8) The Tribunes, and all civil officers of the Republic, shall be removed from office on impeachment for, and conviction of, any imprisonable offence.
Section 7 - Powers of Judiciary
1) The judicial power shall extend: a) to all cases, including cases in what may be referred to as common law, equity and admiralty law, arising under this Constitution, the laws of the Republic, and treaties made, or which shall be made, under her authority; b) to controversies to which the Republic shall be a party; and c) between the and foreign states, citizens or subjects.
2) The Republican Judge shall be removed from office on impeachment for, and conviction of, any imprisonable offence.
Section 8 - Local Government
1) There shall be no local government.
Section 9 - Amendments to the Constitution
1) The Republican Parliament, whenever three-quarters of Members who vote shall deem it necessary, shall propose Amendments to the constitution, which shall be valid to all intents and purposes, as part of this Constitution.
